All purchases made on our website (from now on “andalucia360travel.com”) by the customer (from now on “the Customer”) will be subject to the terms and conditions of the services set forth in this document.

If any aspect of the purchase is not contemplated therein, it will be regulated according to the legislation in force in Spain.

The purchase made by the Client implies his agreement and acceptance of the present terms and conditions of the services. No stipulation made by the Client regarding these terms and conditions may differ from those established by Andalucía 360 Travel DMC, s.l.

All the information that appears in the web pages of www.andalucia360travel.com regarding the services, their characteristics, their prices, their purchase conditions may be modified by Andalucía 360 Travel DMC, s.l. at any time and without prior notice, in order to promptly inform the general public of such changes.

In case of any variation in any service, it will be informed at the time of purchase or at the beginning of the service, the valid and definitive information being provided by the guide at the beginning of the visit. Any of the places planned within the development of each of the visits, may be replaced by another of similar category or characteristics, if special circumstances or force majeure oblige us to do so.

1. SERVICES AND PRICES

1.1 Except for typographical error or omission, the characteristics as well as the prices of the services available for purchase are perfectly reflected in the different web pages that make up the website of www.andalucia360travel.com

1.2 The amount of service prices as well as any of its characteristics may be subject to review by Andalucía 360 Travel DMC, s.l. at any time without having any obligation to notify such modifications to the Client by any means other than the exposure of said changes on its web pages. However Andalusia 360 Travel DMC, s.l. I could notify the Client of any modification by e-mail, telephone or WhatsApp. On the other hand, except for correction of typographical errors, once the service has been purchased, andalucia360travel.com will undertake to keep the current price to the Client at the time he placed his order.

1.3 TAXES:

1.3.1 The prices that andalucia360travel.com shows on its website include taxes.

2. RESERVATIONS

2.1 It will be understood that the Client has freely read, understood and accepted these terms and conditions of the services when making their purchase through the existing reservation forms on the website www.andalucia360travel.com accepting (checking) the box provided to such effect.

2.2 Since there are links on the website www.andalucia360travel.com for the free visualization of these terms and conditions of services, these will also apply to the services requested through any means other than the Internet order form ( by e-mail, by phone or in person). In the event that the Client purchases the services in third places, the Client will be governed by the General Conditions of the site where he makes the purchases, andalucia360travel.com will not be responsible nor will have a legal obligation for the use of such sites.

2.3 Andalucía 360 Travel DMC, s.l. will always reserve the right to accept or deny at own discretion any request for purchase, extension, renewal, modification or change of any of the services displayed on their web pages.

2.4 The Client affirms that all his personal data, such as payment, and purchase data provided to andalucia360travel.com are real and reliable. In the event that andalucia360travel.com verifies that some or all of said data is false, the purchase will be automatically canceled and the Customer will not be able to claim any refund related to the costs incurred by the management.

2.5 In the event that the Client provides data of a third person or entity when making the purchase, the Client shall be solely responsible for the said third person or entity knowingly and expressly accepting such situation. All responsibility for damages and losses that may arise from this fact will fall entirely on the Client, excluding andalusia360travel.com from any responsibility.

2.6 Any indication or query that the Client makes appear in the sections intended for comments on the purchase or in subsequent communications to it will be taken as merely informative and will not condition in any case the purchase made.

2.7 Likewise, andalucia360travel.com reserves the right to retain the purchase of the service pending any information that it needs from the Client.

2.8 The Client is informed of the description of the purchased service and all the information contained in this, time and place of meeting, departure time and duration available on the web. In addition, once the purchase has been confirmed and paid, the Customer will receive a confirmation voucher of the service by e-mail with the order number, the contracted service, number of people, the date, the chosen group … etc.

2.9 The Client will have to show the tour guide the voucher he will receive by e-mail at the end of his purchase, either in digital format or printed on paper.

3. PAYMENTS

3.1 The Client must take account of  payment of their purchases in EUROS, all possible bank charges for currency exchange will be borne by the Client.

3.2 In the event of a chargeback made on a credit / debit card whose cause for return was not due to error directly attributable to andalucia360travel.com, the Customer will be charged with an additional fee of 5% on the value of the amount returned, which will conform the expenses incurred in both bank fees and collection management.

Said amount will be charged to the Client in the terms and forms that andalucia360travel.com deems appropriate.

3.3 PAYMENT METHODS:

3.3.1 The Client must take account of the payment of their purchases in EUROS, all possible bank fees for currency exchange will be borne by the Client.

3.3.2 Payment of the purchase amount must be received by andalucia360travel.com free of bank fees or other expenses arising from the transaction.

3.3.3 Credit card fraud is a crime and andalucia360travel.com will bring legal action against anyone who makes or attempts to make a fraudulent transaction or scam.

4. GUARANTEES AND RESERVATIONS

4.1 andalucia360travel.com states and guarantees that it can perform its own and third party services through its website www.andalucia360travel.com and that it is in possession of sufficient means (both in technical equipment and in provision of services) for the complete process of sale.

4.2 In the event that the organizing company is obliged to suspend the service purchased, the amounts paid will be immediately returned, offering the Customer alternative dates available. The Client will not be entitled to any compensation.

4.3 The abandonment or separation of the group during the visit, for reasons not attributable to the organization, implies the loss of any claim rights.

4.4 The non-presentation at the meeting point at the time indicated both on the website and in the confirmation e-mail implies the loss of any claim rights.

4.4 In the event that the client misses or misappropriates the group guidance system provided by the guide at the beginning of the visit, Andalucía 360 Travel DMC, s.l. will charge € 45.00 for each receiver and € 5.00 for each handset.

5. CANCELLATION AND RETURN

5.1 In case of cancellation request or modification of the purchased service, the Client must do it through an email addressed to [email protected], indicating the order number.

5.2 The cancellation of guided tours with tickets to certain monuments, shows … etc, once confirmed, entails the following expenses that will not be returned:

5.2.1 25% of the price, if canceled in advance from the reservation confirmation up to one week before the activity.

5.2.2 50% of the price, if canceled up to 72 hours before the activity.

5.2.3 No amount will be refunded, if the cancellation occurs within 72 hours before the activity until it is carried out, or if the client does not show up.

5.3 If the cancellation of the purchase of guided tours without tickets to monuments once confirmed, is made more than 24 hours in advance, there will be no cancellation fee and 100% of the amount paid will be refunded.

5.4 The cancellation of the purchase of guided tours without tickets to monuments, once confirmed, entails the following expenses that will not be refunded:

5.4.1 Cancellations made less than 24 hours in advance of the day indicated for the service purchased or the non-presentation on the indicated day, will account for 100% of the service expenses.

5.5 The refund of the amount will be made in the same way in which the payment was made.

andalucia360travel.com will proceed to return the corresponding amount within 48 hours of receiving the cancellation request.

5.6 As established by Royal Decree 1/2007, of November 16, we inform you that our services, given their special nature, are not subject to the Right of withdrawal.

6. RESPONSIBILITIES

6.1 Andalucía 360 Travel DMC, s.l. It is not responsible for what is exclusively attributable to the Client.

6.2 Andalucía 360 Travel DMC, s.l. It is not responsible for the waits that could originate in the accesses of the monuments to be visited, either by the organization and / or internal organization of the monument.

6.3 Andalucía 360 Travel DMC, s.l. is not responsible for delays in services that require transportation due to traffic delay.

6.4 Andalucía 360 Ttravel DMC, s.l. does not accept responsibilities derived from its services, for not meeting the expectations of the client.

6.5 Andalucía 360 Travel DMC, s.l. is not responsible in any way (direct or subsidiary) for any direct or indirect damage that the Client may suffer or cause himself or third parties.

7. COMMUNICATIONS

7.1 The Client is obliged to always keep the e-mail address provided in his order for fluid communications with andalucia360travel.com operational, active and updated, since it constitutes the preferred means of communication for agile management and without problems in the process of the booking management..

7.2 If the Client wishes to change the contact e-mail address provided when making his purchase, he must do so through e-mail communication, complying with the security requirements demanded by andalucia360travel.com in order to verify the legitimacy of the request, so that at no time the communication between both parties is interrupted.

7.3 The Client will be responsible for the consequences that the lack of operability of his e-mail address or that the absence of communication for the update of said data in our records could produce.

7.4 In the event that individual registration and authentication data are assigned to the Client for legitimate access on the websites of andalucia360travel.com (such as username, passwords or passwords), he will be solely responsible for their use, protection and maintenance of your confidentiality. The use of these identifiers and their communication to third parties will occur under the sole responsibility of the Client, the latter being ultimately responsible for the purchases, communications or actions made using said data.

8. LEGAL INFORMATION

8.3 In what is not provided for in this document, as well as in the interpretation and resolution of conflicts that may arise between the parties as a result thereof, Spanish legislation shall apply.

8.4 If there is a conflict or difference between the parties (Client and Company) in the interpretation and execution of this document, and it is not resolved by mutual agreement, it will be resolved at the request of either party and after communication by written to the other, by arbitration.

8.5 All of the above will be understood without prejudice to the parties being able to submit to a judicial proceeding, in which case it will be done before the jurisdiction and jurisdiction of the Courts and Tribunals of Granada, Spain.
